1) Acceptance of Terms
By creating an account, installing or using our software, accessing classes, or receiving tutes through Sipex Online LMS (the “Service”), you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree, do not use the Service.
2) About Sipex Online LMS
Sipex Online LMS provides educational software and services for students, including access to classes and delivery of tutorial materials (“tutes”). The Service is available via Windows (32/64-bit), macOS installer, Android app, and a dedicated iOS web portal. The software is developed and maintained by KJ Developers.
3) Eligibility
- Registration is limited to students in Grade 6 through Grade 11.
- Minimum age to register is 10 years. If you are under the age of majority in your region (e.g., under 18), you must have a parent or legal guardian’s consent.
4) Accounts & Security
- You agree to provide accurate information and keep it up to date.
- You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account.
- Notify us immediately of any unauthorized use or suspected breach.
- Accounts are for individual student use only and may not be shared.
5) Software License & Access
Subject to these Terms, we grant you a limited, personal, revocable, non-exclusive, non-transferable license to install and use the Software to access classes and tutes for your own educational, non-commercial purposes.
- Supported platforms: Windows (32/64-bit), macOS installer, Android app, and iOS web portal.
- Do not reverse engineer, decompile, modify, or circumvent any security/DRM features.
- Do not copy, distribute, export, rent, lease, sublicense, or make the Software available to others except as expressly permitted.
- We may provide updates or patches which you must install to continue using the Service.
6) Fees & Payments
- Access to classes requires payment to our designated bank account. Payment details will be provided by us.
- Access may be activated after payment is received and verified.
- You may not resell or transfer your access.
- Once your payment has been verified by our admin, you cannot request a refund. Sipex Online LMS does not provide any refund policy — all class payments are strictly non-refundable.
7) Community Rules & Prohibited Conduct
To keep our learning environment fair and secure, you agree to:
- Not share your account credentials with others.
- Not publish our class recordings on public platforms without our prior permission (including YouTube, Facebook, Telegram, and similar platforms).
- Not share live session links (e.g., Zoom meeting URLs) with others or post them publicly on social media.
- Not resell or redistribute our documents, recordings, or LMS accounts to others.
- Not engage in any activity that disrupts classes, harms other users, or violates applicable laws.
8) Content & Intellectual Property
- All class materials, recordings, documents, software, and related content are owned by Sipex Online LMS and/or its licensors and are protected by intellectual property laws.
- We provide you a limited license to access and use these materials solely for your personal, non-commercial educational purposes.
- You may not reproduce, distribute, publicly perform, or create derivative works from our content without written permission.
- If you submit content (e.g., assignments or messages), you grant us a limited license to host and process it solely to operate the Service.
9) Live Sessions & Third‑Party Terms
- Live sessions may be hosted on third-party platforms (e.g., Zoom). You must comply with their terms and policies.
- Access to meetings is restricted to authorized students only. Unauthorized sharing or posting of meeting details is prohibited.
- We are not responsible for outages or issues caused by third-party platforms.
10) Delivery of Tutes
- You must provide accurate delivery address details and up to two tute delivery phone numbers for contact.
- We will use this information solely to deliver tutes and to coordinate delivery-related communications.
- Risk of loss or delays may depend on carrier performance and factors beyond our control.
11) Suspension & Termination
- We may suspend or terminate access for violations of these Terms, fraud, non-payment, or to protect users and the Service.
- Upon termination, your license to use the Software and content ends. Certain provisions (e.g., intellectual property, disclaimers, and limitations of liability) will survive termination.
12) Disclaimers
The Service and content are provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose, accuracy, and non-infringement. We do not guarantee uninterrupted or error-free operation.
13) Limitation of Liability
To the fullest extent permitted by law, Sipex Online LMS, KJ Developers, and our officers, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, use, goodwill, or other intangible losses, arising out of or related to your use of the Service. Our total liability for any claim will not exceed the amount you paid for the Service during the six (6) months preceding the claim.
14) Indemnification
You agree to defend, indemnify, and hold harmless Sipex Online LMS and KJ Developers from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your infringement of any rights of a third party.
15) Governing Law & Disputes
These Terms are governed by the laws of Sri Lanka. You agree to the exclusive jurisdiction and venue of the courts located in Sri Lanka for all disputes arising from or relating to the Service or these Terms, unless applicable law requires otherwise.
16) Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you by posting an updated version within the Software or on our site and updating the “Last updated” date above. Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
